On Thursday, 1/7/2016 at 9:00 am, the Facilities Construction and Assisted Care Living Facilities (ACLF) Standing Committees met jointly to continue discussion on whether to grant a waiver for Governor’s Bend Assisted Living which was cited for using a nurse call system that does not have a UL approval . This issue was discussed but unresolved at the previous meeting in November.
Following the joint meeting, the ACLF Standing Committee met to discuss a recently issued Audit Report from the Comptroller of the Currency. The report states that “The board allows unlicensed staff to administer medications in assisted living facilities because rules are unclear regarding who can administer medications and penalties for rule violations are insufficient.” The report notes the staff stated that “it appears assisted care living facilities preferred to pay the fines when penalties are issued against them, instead of hiring higher paid licensed staff, like licensed nurses, to administer medications.” The Comptroller recommended that the Board amend its rules to clearly describe licensed medical practitioners (registered nurses or LPNs) as the only individuals qualified to administer medications, including in ACLFs.
The standing committee discussed what action to take regarding this report and may possibly recommend a rule to the full Board for consideration. If a new rule is recommended, it would have to be approved by the full board to go to a Rule-making Hearing. Public comments would be considered at such hearing.
